1. Acceptance of Terms
Use of this website implies acceptance of these Terms and Conditions. Kluger Byte operates under Andorran legislation. These terms are general and apply solely to website use and service offerings displayed. Any specific agreement or contract signed between Kluger Byte and a client shall prevail over these general terms.
2. Service Description
Kluger Byte provides professional B2B services in web development, custom software, and technical consulting. Information presented on this site is descriptive and does not constitute a binding commercial offer. No commercial or business results derived from the use of developed software are guaranteed.
3. Intellectual Property
Kluger Byte retains ownership of code, documentation, and project deliverables until full payment. Upon complete payment, the client acquires usage rights and ownership of code developed specifically for their project. Kluger Byte maintains permanent rights over internal tools, methodologies, reusable components, proprietary libraries, know-how, and any non-exclusive project elements. The client does not acquire rights over pre-existing or third-party material included in the project.
4. Use of Delivered Material
The client may use the software and deliverables exclusively for the purposes intended in their project. Reproduction, sublicensing, resale, or reuse in unrelated projects is not permitted without prior written authorization from Kluger Byte.
5. Client Responsibilities
The client is responsible for providing sufficient information, necessary technical access, and resources that enable proper project execution. The client is also responsible for content they publish, third-party licenses they use, and their own hosting infrastructure.
6. Limited Warranty
Software is delivered 'as is' and only functionality previously agreed upon in writing is guaranteed. Compatibility with unspecified systems or results derived from software use are not guaranteed. Kluger Byte will correct critical errors reported within a reasonable period after delivery.
7. Limitation of Liability
Kluger Byte's total liability for any claim related to services provided is limited to the amount paid by the client for the corresponding project. Kluger Byte shall not be liable for data loss, indirect damages, loss of profits, or failures caused by third-party services or infrastructure.
8. Confidentiality
Kluger Byte and the client shall maintain confidentiality of technical, commercial, or sensitive information exchanged during collaboration. This obligation remains in effect after project completion.
9. Termination
Service termination shall be governed by provisions stipulated in the specific contract or proposal signed between parties. In the absence of a specific contract, either party may terminate collaboration by providing reasonable notice and paying for work executed to date.
10. Modifications
Kluger Byte may update these Terms by publishing them on this website. Continued use of the site after updates implies acceptance of new terms.
11. Applicable Law
These terms are governed by Andorran legislation. Any dispute related to the use of this site shall be submitted to the competent courts of Andorra.
